1. Acceptance of Terms & Eligibility

Welcome to Curiva Med Spa ("Curiva Med Spa," "we," "our," or "us"). By accessing our website, www.curivamedspa.com (the "Site"), or using any of our services, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you must not use our Site or services.

  • Privacy Policy: Your use of our Site and services is also governed by our Privacy Policy, which is incorporated into these Terms by this reference. By agreeing to these Terms, you also acknowledge and agree to the data practices described in our Privacy Policy.
  • Age Requirement: You must be at least 18 years of age to use our Site and services. By using our Site and services, you represent and warrant that you are 18 years of age or older.

2. Medical Disclaimer

The content on our Site is for informational purposes only. Curiva Med Spa provides health and wellness services but does not offer medical advice unless explicitly prescribed by our licensed clinicians. Our services and products are not intended to diagnose, treat, cure, or prevent any medical condition. Always consult with a qualified healthcare provider before beginning any treatment, especially if you are pregnant, nursing, or have a pre-existing medical condition.

3. Website and Intellectual Property

  • Intellectual Property: All content on the Site, including text, graphics, logos, and images, is the exclusive property of Curiva Med Spa and is protected by intellectual property laws. You may not reproduce, distribute, or use this content without our prior written consent.
  • Prohibited Uses: You may not use the Site for any unlawful purpose. Unauthorized use may result in the termination of your access.
  • Third-Party Links: Our Site may contain links to external websites for your convenience. We do not endorse and are not responsible for the content or practices of these third-party sites.

4. Appointments & Clinical Policies

  • Cancellation Policy: We require a minimum of 24 hours’ notice to cancel or reschedule an appointment. This allows us to accommodate other clients. Failure to provide 24-hour notice (late cancellation) or failure to appear for a scheduled appointment (no-show) will result in a cancellation fee of $50.00. For appointments that were part of a prepaid package, the service associated with that appointment will be forfeited.
  • Discretionary Rescheduling: At our sole discretion and on a case-by-case basis, we may allow a one-time reschedule for a client who provides less than 24 hours' notice. This is contingent upon payment of a $50.00 refundable deposit. The deposit will be refunded upon completion of the rescheduled appointment. If the client fails to appear for the rescheduled appointment, the deposit will be forfeited.
  • Late Arrival Policy: If you are more than 15 minutes late for your appointment, we may need to reschedule your service. If we cannot accommodate you, the cancellation policy will apply.
  • Right to Refuse Service: We reserve the right to refuse or discontinue service to any person. This includes, but is not limited to, situations involving: verbal or physical harassment of staff or other clients; threats of violence; being under the influence of alcohol or illicit drugs; or repeated failure to adhere to clinic policies after being given a warning.
  • Client Cooperation: By purchasing a service, you agree to cooperate fully by following all instructions provided before, during, and after your treatment.

5. Products, Services & Payments

  • Pricing and Offers: All prices for products and services are subject to change without notice. We reserve the right to limit or refuse any order you place with us. If we make a change to or cancel an order, we will attempt to notify you via the contact information provided at the time the order was made.
  • Payment: All services offered are elective procedures and are not covered by public or private insurance. Payment is required in full before any services are rendered. You confirm that you are authorized to use the selected payment method and consent to all charges.
  • Payment Disputes: We encourage clients to contact us directly at hello@curivamedspa.com to resolve any payment disputes. If you initiate a chargeback with your credit card company for a valid charge, we reserve the right to present our terms, your authorization, and proof of service to the financial institution. Unwarranted chargebacks may result in the suspension of future services.

6. No Guarantee of Results

Results from aesthetic treatments vary from person to person and are not guaranteed. Factors such as individual physiology, lifestyle, and adherence to pre- and post-treatment care instructions can affect the outcome. We do not guarantee specific results for any treatment or service.

7. Refund and Return Policy

  • Services: All sales of services and treatment packages are final. No cash or card refunds will be provided. Unused services may not be transferred to another individual.
  • Discretionary Refunds: Should a refund be approved at our sole discretion, it will be issued as store credit only.
  • Medical Unsuitability: If a client is deemed medically unsuitable to continue with a pre-purchased treatment, we will first attempt to find a suitable alternative service. If no equivalent service is available, a partial store credit for the value of the unused treatments will be issued, which can be applied to other services or products.
  • Products: Unopened products may be returned within 30 days of purchase with an original receipt. Opened products may be returned within 14 days of purchase with an original receipt. All approved product returns will be issued as store credit only.

8. Dispute Resolution by Binding Arbitration

  • Agreement to Arbitrate: Any dispute, claim, or controversy arising out of or relating to these Terms or your use of our services shall be determined by binding arbitration in Los Angeles, California.
  • Class Action Waiver: You agree that any arbitration will be conducted in your individual capacity only and not as a class action or other representative action. You expressly waive your right to file a class action or seek relief on a class basis.
  • Governing Law: These Terms are governed by the laws of the State of California.

9. Disclaimer of Warranties; Limitation of Liability

Our Site and services are provided on an "as is" and "as available" basis. We disclaim all warranties, express and implied. To the maximum extent permitted by law, Curiva Med Spa shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Site or services. Our total liability to you shall not exceed the amount you paid for services or ten U.S. dollars ($10), whichever is greater.

10. Indemnification

You agree to indemnify and hold harmless Curiva Med Spa from any claims, damages, or expenses (including legal fees) arising from your use of the Site or violation of these Terms.

11. Updates to These Terms

We reserve the right to modify these Terms at any time. Changes are effective immediately upon posting for all new users of the Site and services. For existing clients, we will provide notice of any material changes to these Terms via the email address on file. Your continued use of our services 30 days after such notification will constitute your acceptance of the new Terms.

12. Miscellaneous

  • Entire Agreement: These Terms and our Privacy Policy constitute the entire agreement between you and Curiva Med Spa regarding your use of our Site and services and supersede all prior or contemporaneous understandings and agreements, whether written or oral.
  • Severability: If any provision of these Terms is found to be invalid or unenforceable by a court, that provision shall be severed, and the remaining provisions shall remain in full force and effect.

13. Curiva Med Spa Loyalty Club: Terms and Conditions

Welcome to the Curiva Med Spa Loyalty Club (the "Program"). By participating in the Program, you (the "Member" or "Patient") agree to the following terms and conditions. These terms constitute a legal agreement between you and Curiva Med Spa.

13.1 Membership & Eligibility

  • Automatic Enrollment: All patients of Curiva Med Spa are automatically enrolled in the Loyalty Club upon their first qualifying transaction.
  • No Cost: There are no fees to join or maintain membership in the Program.
  • Individual Accounts: Points are non-transferable and are tied strictly to the individual patient profile. Points may not be pooled or combined with other patients.
  • Revocable License: Points and rewards are a limited, revocable license and do not constitute property of the Member. Members have no "vested rights" in any points or rewards.

13.2 Earning Points

Points are earned on the net dollar amount spent on qualifying treatments and services at Curiva Med Spa, excluding taxes, shipping, and gratuities.

  • Introductory Promotional Period: From program launch through May 31, patients earn five (5) points for every $1.00 spent.
  • Standard Earning Period: Beginning June 1, the earning rate transitions to one (1) point for every $1.00 spent.
  • Timing: Points are typically credited to the patient profile within 24–48 hours following the completion of a visit and full payment.
  • Exclusions: Points are not earned on the purchase of gift cards, but the redeemer of a gift card will earn points on services rendered.
  • Rounding: Points are rounded down to the nearest whole dollar.

13.3 Redemption Value & Process

  • Point Valuation: For redemption purposes, 100 points = $1.00 USD.
  • Universal Redemption: Points may be redeemed toward any treatment or service offered at Curiva Med Spa, subject to availability.
  • No Restrictions: There are no "blackout dates" for point redemption.
  • Redemption Method: To use points, patients must notify the front desk team at the time of checkout.
  • Combination with Discounts: Unless otherwise stated, points may be combined with other promotional offers or discounts.

13.4 Expiration & Forfeiture

  • Inactivity Expiration: Points will expire twelve (12) months from the date they were earned if there has been no qualifying activity (earning or redeeming) on the account. Qualifying activity resets the clock for the remaining balance.
  • Termination of Account: If a patient's relationship with Curiva Med Spa is terminated for cause (e.g., violation of spa policies, late cancellation patterns, or disruptive behavior), all accrued points will be forfeited immediately.

13.5 Dispute Resolution & Mandatory Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR RIGHTS.

  • Individual Arbitration: Any dispute or claim relating in any way to the Program will be resolved by binding, individual arbitration, rather than in court.
  • Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
  • Governing Law: These terms are governed by the laws of the state in which Curiva Med Spa is registered.

13.6 Limitations of Liability

  • Curiva Med Spa is not responsible for any technical errors in point calculation or profile display. In the event of a discrepancy, Curiva Med Spa’s internal records shall be deemed correct.
  • Curiva Med Spa makes no warranties, express or implied, regarding the Program.

13.7 Program Changes & Termination

Curiva Med Spa reserves the right to modify, suspend, or terminate the Loyalty Club, its earning rates, or redemption values at any time, with or without notice.

  • Material Changes: In the event of a material change that negatively impacts current balances, Curiva Med Spa will attempt to provide 30 days' notice via the email address on file.
  • Tax Liability: Members are responsible for any tax liability (including income tax) related to the receipt or redemption of points.
